Welcome to BeforeSocial! Please read these Terms of Service ("Terms") carefully before using the beforesocial.app website (the "Service") operated by BeforeSocial ("us," "we," or "our").

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.

1. The Service

BeforeSocial provides a tool for users to create, visualize, and export mockups of social media profiles and posts ("Mockups"). The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We may modify, suspend, or discontinue the Service at any time without notice.

2. Accounts

When you create an account with us, you guarantee that you are above the age of 18 and that the information you provide is accurate, complete, and current at all times.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. User Content

Our Service allows you to upload, create, and store text, images, and other information ("User Content") to generate your Mockups. You are solely responsible for the User Content you post on or through the Service.

You retain any and all of your rights to any User Content you submit. By submitting User Content, you grant us a limited, worldwide, non-exclusive, royalty-free license to use, store, display, reproduce, and distribute such User Content on and through the Service, solely for the purpose of operating, developing, and providing the Service to you.

You represent and warrant that: (i) the User Content is yours (you own it) or you have the right to use it and to grant us the rights and license as provided in these Terms, and (ii) the posting of your User Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity.

4. Acceptable Use

You agree not to use the Service for any purpose that is illegal or prohibited by these Terms. You agree not to:

  • Upload any content that is defamatory, obscene, pornographic, or hateful.
  • Upload any content that infringes upon the copyright, trademark, or other intellectual property rights of any third party.
  • Attempt to interfere with the proper functioning of the Service, compromise its system integrity or security, or decipher any transmissions to or from the servers running the Service.

5. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of BeforeSocial. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

6. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

7. Limitation of Liability

In no event shall BeforeSocial, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

8. Disclaimer

Your use of the Service is at your sole risk. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Victoria, Australia, without regard to its conflict of law provisions.

10. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect.
