Welcome to BeforeSocial! Please read these Terms of Service (“Terms”) carefully before using the beforesocial.app website (the “Service”) operated by BeforeSocial (“us,” “we,” or “our”).

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.

1. The Service

BeforeSocial provides a free, browser-based tool for users to create, visualize, and export mockups of social media profiles and posts (“Mockups”). All editing and image generation happen entirely in your browser. We do not store your content on our servers. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We may modify, suspend, or discontinue the Service at any time without notice.

2. User Content

The Service allows you to input text, upload images, and create mockups (“User Content”). All User Content is processed locally in your browser and is not uploaded to our servers. You are solely responsible for the User Content you use with the Service.

You retain any and all of your rights to your User Content. You represent and warrant that: (i) the User Content is yours (you own it) or you have the right to use it, and (ii) the use of your User Content does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person or entity.

3. Acceptable Use

You agree not to use the Service for any purpose that is illegal or prohibited by these Terms. You agree not to:

  • Create mockups containing content that is defamatory, obscene, pornographic, or hateful.
  • Create mockups that infringe upon the copyright, trademark, or other intellectual property rights of any third party.
  • Attempt to interfere with the proper functioning of the Service, compromise its system integrity or security, or decipher any transmissions to or from the servers running the Service.

4. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of BeforeSocial. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

5. Limitation of Liability

In no event shall BeforeSocial, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

6. Disclaimer

Your use of the Service is at your sole risk. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of Victoria, Australia, without regard to its conflict of law provisions.

8. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect.
